Do not rely on any published docket time for this court right now, including ours. The court has been transitioning to a new schedule and recommends calling the clerk’s office ahead rather than assuming. The date and time printed on your summons is what controls.

On continuances: a first continuance can be granted by the clerk, but only with the consent of all parties. On a criminal charge it also requires the consent of the Commonwealth’s Attorney. Anything after the first goes to the judge. Reckless driving is a criminal charge, so it falls under the second rule, not the first.

Interstate 95 is the dominant source. It runs through the county past Thornburg and Massaponax on one of the busiest stretches in Virginia, and it fills the General District Court’s traffic docket with drivers who were passing through and have no easy way to return.

The other corridors:

  • Route 208 (Courthouse Road), which runs from Lake Anna through Spotsylvania Courthouse to Four Mile Fork and is the road the courthouse itself sits on
  • U.S. Route 1, running parallel to I-95
  • U.S. Route 17 and Route 3, both feeding the Fredericksburg area

Traffic infractions, criminal misdemeanors, and some civil matters. That includes reckless driving, speeding, DUI, driving on a suspended license, simple assault, public intoxication, and petty larceny.

The court also conducts preliminary hearings on felony charges, which proceed to the Circuit Court if certified.

General District Court does not conduct jury trials. Every case there is decided by a judge.

The line is whether the charge is an infraction or a crime.

Prepayable traffic infractions, such as most speeding tickets, can be resolved without a hearing. You may prepay, or enter a written appearance and waive the hearing under Va. Code § 19.2-254.1, and an attorney can handle the matter without you present.

Reckless driving is a criminal misdemeanor. It cannot be prepaid and it requires a court appearance. Some Virginia courts will grant a waiver of appearance for out-of-state defendants, but that is at the judge’s discretion and cannot be promised in advance.

DUI and other criminal misdemeanors generally require you to appear in person.

For eligible traffic infractions, prepayment resolves the case and waives the court appearance. Virginia’s court system allows this online.

Understand what prepaying actually is. It is not a fee to make the ticket go away. Prepayment is a guilty plea. The conviction goes on your record, the demerit points attach, and your insurer can see it. Once entered it is difficult to undo.

Prepayment is not available for criminal-level offenses like reckless driving. If your summons says you must appear, that is the tell that the charge is not a simple infraction.

Reckless driving is a Class 1 misdemeanor, not a ticket. Under Va. Code § 46.2-862, you are charged with it at 20 mph or more over the posted limit, or any speed in excess of 85 mph regardless of the limit.

On I-95 the second number is what catches people. The interstate is posted at 70 through Spotsylvania, so the 20-over line is 90 mph. But the 85 mph rule arrives first. At 86 mph you are charged with a criminal offense while doing 16 over the limit.

Penalties on conviction:

  • Up to 12 months in jail
  • Fine up to $2,500
  • 6 DMV demerit points
  • Lasting criminal record
  • License suspension of 60 days to six months, at the court’s discretion under Va. Code § 46.2-393

Two different record clocks. The demerit points stay active for 2 years from the date of the offense. The conviction itself stays on your Virginia driving record for 11 years.

New as of July 1, 2026: on a reckless driving by speed conviction, the court may order enrollment in Virginia’s Intelligent Speed Assistance Program instead of suspending your license. That means a speed-limiting device on any vehicle you own or operate, at your expense, for 60 days to six months. Over 100 mph, the court must order it unless it suspends your license instead.

On a reckless driving charge, the main route is a reduction to improper driving. Under Va. Code § 46.2-869, a court may grant it where the defendant’s culpability is slight based on the facts. It can also arrive by agreement with the Commonwealth.

A police officer cannot write a ticket for improper driving. It exists only as a reduction. Whether it is available depends on the speed, the driving record, the conditions, and how the case is presented. Higher speeds, an accident, or prior convictions make it less likely.

Results depend on the specific facts of each case. Prior outcomes do not guarantee or predict a similar result in any other matter.

Failing to appear does not delay the case. It makes it worse, and it creates a second problem on top of the first.

  • The court can hear the case and enter a finding in your absence
  • The court can issue a bench warrant for your arrest, which does not expire and which will surface at any future traffic stop, anywhere
  • Additional court costs
  • Under Va. Code § 46.2-395, the court notifies DMV, and your license or privilege to drive in Virginia can be suspended until the matter is resolved
  • Failure to appear can itself be charged separately

If you hold an out-of-state license, a Virginia suspension for failure to appear is reported to your home state, which commonly acts on it. A missed date in Spotsylvania can cost you the ability to drive where you live.

If you cannot make your date, deal with it before the date, not after.

The court procedure is the same. What differs is what happens afterward.

Virginia reports convictions to your home state through the Driver License Compact, an interstate agreement covering 45 states and the District of Columbia. Your home state then applies its own rules, which commonly means adding the conviction to your record, imposing its own penalties, and counting it as a prior if you are charged again.

How your home state treats it is up to your home state, and the rules vary. A Virginia conviction is reported. What happens next is not something a Virginia court controls or that anyone can promise you in advance.

Non-compact states: Georgia, Massachusetts, Michigan, Tennessee, and Wisconsin are not members. That is not the same as no consequence, as serious offenses can still reach your record through other channels.

CDL holders: a DUI conviction in any state disqualifies your commercial driver’s license nationwide, regardless of interstate compacts.

You have an automatic right of appeal within 10 days. You do not need permission and you do not need to show the first judge got anything wrong.

The appeal goes to Spotsylvania Circuit Court as a trial de novo, meaning an entirely new trial. The General District Court result is set aside. The Commonwealth has to prove its case again from the beginning, and you can have a jury.

Understand the tradeoff before you appeal. A trial de novo starts over completely, which means the Circuit Court is not bound by the sentence you received below. The outcome can be better, and it can be worse. That is a decision to make with counsel and with the facts of your case in front of you, not on principle.
