Samantha Upton represented a young lady charged with driving 91 mph in a 60 mph zone in Dinwiddie County, Virginia.  Many courts, including this one, will treat a 91/60 mph case as the equivalent of 101 mph in a 70 mph zone.   This means that in addition to the client’s appearance being required and a very little to no chance of reduction, the client was looking at a 6 month loss of license and the possibility of an active jail sentence.   This particular client had just started graduate school in Washington State and this was going to be a problem for her.  She was also very concerned about the Misdemeanor conviction.

Ms. Upton was able to work out an agreement for the case to go forward without the client having to appear.   This was a win itself because it solved the travel issue and also eliminated the possibility of an active jail sentence.   Furthermore, Ms. Upton worked out a mitigation strategy with her client and was able to use that mitigation to convince the Judge to reduce the Reckless Driving Misdemeanor all the way down to an equipment violation.

The client never appeared for Court, avoided a license suspension, avoided a jail sentence, avoided the Misdemeanor, and even avoided points on her driving record.   She will suffer no insurance consequences and only had to pay a $100.00 fine.
